The Law Employers have a general duty under the Health and Safety at Work, etc Act 1974 (HSWA) to ensure, as far as is reasonably practicable, the health, safety and welfare of employees. If an employer knowingly allows an employee under the influence of drugs or excess alcohol to continue working, and this places the employee or others at risk, they could be prosecuted. Similarly, the HSWA requires employees to take reasonable care of themselves and others who could be affected by what they do.
The stats It is a fact that 1 in 5 drivers are caught out drink driving the following morning from having consumed alcohol from the night before. Certain drugs can remain detectable for up to 28 days after having been taken.
How can we help?
We offer a professional service coming to your premises to undertake both drink and drug testing randomly on staff that you employ. We can set you up on a subscription type service whereby we come to you as many times as you would like to use our service/s. Testing for alcohol takes just a few seconds for each donor and will not impact on the working day having taken just a few moments. Drug testing is a little more time consuming and we recommend a minimum of 20 minutes to carry out a check.
If you decide to use our service/s and book for a 12 month subscription we will reduce the first 3 months to just £49 per visit (Usual price is £149) and for the remaining 9 months it will be £99 per visit plus the cost of the tests carried out, The alcohol test procedure cost is £1 per test using the latest Home Office approved equipment. Each donor will receive a print out and a full report of their result and the employer can keep a copy for their own staff record as well. For drug testing the prices would vary from £7 to £40 per test depending on which testing kit we use. If it is a requirement to send off non negative tests to the lab for a full report the cost would also be added to the test.
Important Note - Random testing Drug testing should only be introduced following proper consultation with staff and their representatives and should be even-handed. The Health and Safety Executive (HSE) recommends, in INDG 240, that for alcohol screening, "in addition to changes to the contract of employment, you should obtain the written consent of the individual for each test". The employer needs to demonstrate that testing for drugs and/or alcohol is necessary to combat risk and is limited to those employees that need to be tested to deal with a specific risk. The employer must obtain informed consent from an employee before carrying out a drug test.
An employer could be liable to prosecution under the Equality Act 2010 for targeting drug testing at a particular group or for implementing drug testing in a discriminatory way. Selection for testing must be genuinely random.
Policy Companies that are concerned about alcohol or drugs in the workplace should have a drugs and alcohol policy which contains a clear outline of the aims and purposes of the policy and set out the rules and procedures around alcohol and/or drug use. The policy on testing should:
outline who is covered by the policy and whether a particular group (eg employees carrying out safety-critical work) is subject to tighter restrictions
outline what constitutes misuse
outline the testing procedure and why the test is necessary
outline what happens if a test proves positive and the disciplinary action that may be taken.
The policy should be developed in consultation with staff and union representatives.
